Service can take many different forms.
You might assume that I was referring to how fast the wine waiter refills my glass – that would be a natural assumption.
As the weather turns colder, maybe I’m considering getting the boiler serviced – blue is just not my colour!
Or you might think I’ve suddenly taken an interest in tennis – highly unlikely.
But actually, I was thinking about the service of documents in legal proceedings, particularly particulars of claim. Getting it right is essential, and whilst some mistakes can be corrected (like filling up my glass late – better late than never) some legal mistakes cannot be overcome. For example, if you make a mistake in serving your proceedings, such that they are struck out, if your claim is now time barred, you cannot reserve them, and your claim dies, like my central heating!
With central heating problems, I can always put on another jumper or plug in a fan heater.
Once a civil claim is dead and out of time, no manner of engineering or clothing can fix it.
Obviously, if you instruct reliable solicitors, they will know how to make sure that service is done properly, particularly if there is a risk of a defective claim being struck out. However, as the economy becomes weaker, people are more inclined to try and do things themselves, which may reduce the costs, but can increase the risks. All the court rules apply to everyone equally, whether legally represented or not, and not being able to afford legal advice is not a defence.
